Justice Khalid Ishaq of the Lahore High Court issued a 28-page written judgment on constitutional petitions filed by The University of Faisalabad and other institutions. The court rejected all three petitions of private medical colleges challenging PMDC's notifications dated April 28, 2025, October 6, 2025 and March 11, 2026, while allowing 12 constitutional petitions filed by students. In the written judgment, the court stated that under Section 20 of the Pakistan Medical and Dental Council Act, 2022, the PMDC has the statutory authority to review, approve, modify and fix the appropriate limit on the fees of private medical and dental colleges. According to the Court, sub-sections 7 and 8 of Section 20 of the Act must be read not separately but in conjunction. Along with fixing and announcing the fees, the educational institutions are required to provide the proposed fee structure, financial statements and justification of the fee increase to the PMDC, so that the council can prevent unfair fees. Justice Khalid Ishaq said in the judgment that PMDC is within its legal powers to set a general maximum limit of fees, but while fixing fees, the actual financial costs of educational institutions, academic standards and individual financial circumstances must also be taken into consideration. The court further held that under Article 18 of the Constitution, freedom of business and economic activities is not unconditional, the state can impose appropriate restrictions for public interest, protection of students and maintenance of educational standards. Private medical colleges cannot charge students unfair fees on the basis of constitutional freedom.
